TRAFFIC REGULATIONS ‑ ACCIDENTS
a. General.
(1) Any driver involved in a motor vehicle accident shall comply with the following:
(a) STOP.
(b) As necessary, establish traffic control to prevent other accidents from occurring.
(c) Render first aid to injured.
(d) Notify the nearest law enforcement authorities of the accident. Accidents occurring on the Naval Training Center will be reported to the Center Police, extension 4331 or 4444.
(e) Not move the vehicle unless authorized by a designated representative of the Commanding Officer, an agent of the Security Department, or competent law enforcement agent.
TRAFFIC REGULATIONS ‑ ENFORCEMENT
b. Authority and Responsibility
(1) Security Department, Naval Administrative Command.
(a) The primary traffic enforcement program will be administered by the Director of Security through the following:
1. Center Police
2. Gate Sentries
3. Traffic Accident Investigators
4. Traffic Court
(b) Center Police are empowered to Issue traffic citations for violations of this instruction observed or brought to their attention for all violations committed on this Center by the operator of any motor vehicle.
C. Citations. Operators of motor vehicles issued citations in accordance with the above will appear at Traffic Court in accordance with the instructions on the reverse side of the Armed Forces Traffic Ticket except that violators from other activities may elect to appear in Traffic Court at their home base. After five (5) working days have elapsed and the violator has not appeared before the Traffic Court of this Center, a copy of the traffic citation will be forwarded to the violator's home station for action.
d. Administrative Action
(1) The point assessment method of evaluating an operator's driving record is used aboard this Center.
(2) The use of this system shall not preclude the use of disciplinary or other judicial action.
(3) The operators of all vehicles subject to this 'instruction are eligible to receive action under this system.
(4) When a violator has accumulated a specified number of points,
his Center operating privileges may be suspended for a stipulated period of time or indefinitely revoked. An accumulation of 12 traffic points within 12 consecutive months or 18 traffic points within 24 months will result in the mandatory indefinite revocation of driving privileges.
(5) When notified by civilian authorities that an employee or member of the Naval Training Center has been convicted of a serious traffic offense by civil authorities, the Law Enforcement Officer may suspend the individual's driving privilege on the Center. (6) Points will be assessed and recorded on OPNAV 5560/1 (NonGovernment Vehicle Registration Form).
(7) For violations committed either in a government or privately owned vehicle by holders of U.S. Government Motor Vehicle Operator's Identification Card (Standard Form 46), the holder may be assessed points against either or both their privately owned or government vehicle record, at the discretion of the Traffic Court.
(8) Points will be assessed whenever a violator has:
(a) Been convicted of a traffic violation.
(b) Forfeited bail in a civilian court in lieu of hearing or trial for a moving vehicle violation.
(c) Received nonjudicial punishment pursuant to Article 15, Uniform Code of Military Justice, for a moving traffic violation.
(d) Received notification of a violation for which points are assessable through the use of an Armed Forces Traffic Ticket (DD Form 1408), and failed to appear in Traffic Court as directed.
(9) Points will remain in effect for a 24 month period or until reenlistment, whichever occurs first. Expiration of an indefinite suspension period will cause removal from the record of all points assessed.
e. Federal Magistrate System. The Federal Magistrate Systerm is authorized for use on the Naval Training Center. This system is designed
for traffic and minor criminal offenses committed on board the Center by non‑military personnel. The regulations governing these violations may be found in the Procedures Manual for Disposition of Federal Traffic and Related Petty Offenses in the Southern District of California, which is published by the U.S. Magistrate, San Diego, California. This system provides for civilian violators to be issued a citation to appear before a Federal Magistrate in U.S. District Court. For most offenses coll ateral may be posted by mail and forfeited in lieu of appearing in court. Other more serious offenses involve mandatory court appearances. Failure to appear will result in arrest by Federal Authorities. |
