24. NTC DRIVING REGULATIONS a. Definition of Terms. The words and phrases as defined by the Vehicle Code, State of California, shall apply in this instruction except as modified below: (1) Command. The Naval Training Center, San Diego, California, and all areas under the jurisdiction of the Center Commander. (2) Center Commander. The Center Commander, Naval Training Center, San Diego, California 92133. (3) Driver. Synonymous and interchangeable with "operator.'' (4) Emergency Vehicle. Any vehicle identified and authorized for use in law enforcement, accident investigation, fire protection, security, crash or rescue work and emergency public works service. In addition, all vehicles of the Center equipped with an authorized red light or siren when utilizing same. (5) Roadway. Any roadway, street, place or area on Center used for the movement of motor vehicles. (6) Load. Any part of anything carried or towed by a motor vehicle. (7) Motorcycle. Any two wheeled motor driven vehicle. (8) Motor Vehicle Accident. Any incident involving a motor vehicle in motion that results in personal injury or property damage, no matter how slight. (9) Director of Security. The Director of Security, Naval Administrative Command, San Diego, California. (10) Center. Synonymous and interchangeable with "Naval Training Center" and "Command.'' (11) Aboard or On Board. On the grounds and/or roadways of the Naval Training Center, San Diego, California. b. Jurisdictional Area. All geographical areas under the jurisdiction of the Center Commander, Naval Training Center, are designated CONTROLLED AREAS. c. Privilege of Coming Aboard. Persons failing to meet the requirements of this instruction may be denied the privilege of coming aboard the Center. Those who have been extended the privilege of driving on the Naval Training Center who fail to comply with the provisions of this instruction may be subject to administrative action under the Navy Civilian Personnel Instructions or prosecuted in Federal Court for violation of Title 18, United States Code, as applicable. d. Penalties. ''Whoever falsely makes, forges, counterfeits, alters, or tampers with any naval, military, or official pass or permit issued by or under the authority of the United States or with intent to defraud, uses or possesses any such pass, or personates or falsely represents himself to be or not to be a person to whom such pass or permit has been duly issued, or willfully allows any other person to have or use such pass or permit, issued for his use alone, shall be fined not more than $2,000.00 or imprisoned for not more than five years or both." ‑ Section 499, Title 18, United States Code. e. California Vehicle Code. The Vehicle Code, State of California, except as herein supplemented by NTC Regulations, shall govern the movement of all motor vehicles, bicycles, motorcycles, motor‑scooters and pedestrian traffic aboard the Center. f. Trespassers. Unauthorized persons (trespassers) entering upon the Center are subject to prosecution under Section 1382, Title 18, Unites States Code. g. Reporting Violators. It shall be the duty of all personnel aboard to be observant or unauthorized persons or any violation of this instruction. Any person observed who is unable to show a valid pass, badge, or identification card authorizing that person to be on‑station will be detained and the Center Police (telephone extension 4444) notified without delay. Reports of other violations may be made informally in person, in writing, or by telephone to the Center Police. h. Implied Consent. Any person granted the privilege of operating a motor vehicle on a military reservation shall be deemed to have given his/ her consent to a chemical test for the purpose of determining the alcohol content of his/her blood if cited or lawfully apprehended for any offense allegedly committed while driving or in actual physical control of a motor vehicle on the installation while under the influence of intoxicating liquor. The test shall be incidental to a lawful apprehension and administered at the direction of the law enforcement official having reasonable cause to believe such person was driving or was in actual physical control of a motor vehicle upon the installation while under the influence of intoxicating liquor. Failure to submit to or complete such • chemical test will result in the suspension of his privilege to operate • motor vehicle for a period of six months. |
